Exhibitors and providers (hereinafter referred to as providers) publish their own content on the Messe Luzern AG event websites (hereinafter referred to as online platform). Visitors can obtain information about events on the online platforms. They also have the option of creating an account free of charge in order to use additional functions (hereinafter referred to as members).
The operator of the respective online platform is Messe Luzern AG (hereinafter referred to as the operator). These terms of use govern the rights and obligations of the operator and the members in connection with the online platform. Information on data protection can be found in the Privacy Policy.
The operator makes the online platform available to visitors and members upon request. The individual functions and services are determined by their availability when visiting and using the online platform, as well as by any information published by the operator about individual functions and services. There is no entitlement to use the online platforms or certain functions and services.
The operator allows visitors to create an account free of charge, thereby becoming members. Members can use additional features of the online platform by logging into their account.
Members can use various functions to prepare for their visit to the event. This includes creating a watch list, registering for events, contacting providers and receiving personalized recommendations for attending events. Members or providers can scan the QR code of a member, if available, to obtain their contact details including the email address of the scanned member.
Members can visit selected content and areas of the online platform (if available) that are not accessible to visitors without an account.
Members can follow topics and providers. On the basis of the topics and providers followed and the behavior on the online platform, it generates a personalized newsfeed and personalized recommendations for events for the member and regularly sends personalized updates by email and other communication channels. Members can object to receiving these updates at any time ("opt-out").
Members have a public profile on the online platform (only the Zebi online platform is excluded). They can deactivate this at any time, in which case they will no longer have a public member profile. Members with a public member profile can find and view other public member profiles and can be found and viewed by them. If available, members with a public member profile can see the participants of events with a public member profile. Providers with the corresponding functionality can see which members have visited and interacted with their content. For members with a public member profile, they will see the information from the public member profile, and for members without a public member profile, they will see limited information without the member's name.
Members with a public member profile can send messages to other members with a public member profile. Members can deactivate the message function at any time. In this case, they can neither write nor receive messages.
The operator is authorized to have all or individual functions and services in connection with the online platform performed by commissioned or otherwise involved third parties. The operator is entitled to adapt and further develop the online platform as a whole or in relation to individual functions and services. The operator informs members in an appropriate manner about significant adjustments.
Visitors who create an account are obliged to provide complete and truthful information at all times. Registration with false or fictitious information is prohibited. The operator is authorized – also retrospectively – to check information provided by members or have it checked by third parties, and to request additional information from members.
Registration is restricted to members who are natural persons with unlimited capacity to act. Members are obliged to treat their access data for the online platform confidentially and to use it exclusively for their own purposes.
Members can delete their account at any time under "My account."
Members are obliged to use the online platforms exclusively as intended and in accordance with the law.
Providers are obliged to record or publish only content that complies with the law, for example in their provider profile or when contacting providers and members. In particular, they are obliged not to publish any discriminatory, false, misleading, racist, harmful, criminal or unsafe content.
Use of the online platform for unsolicited or otherwise inadmissible advertising ("spam") is prohibited. Sending spam to providers and other members is prohibited. The operator can monitor the messages that members send and take measures if spam is suspected
The collection or publication of content that infringes intellectual property rights, personal rights or other rights of third parties is prohibited (for example, images that infringe the right to one's own image or the copyright of third parties). Members must assume that content from the operator, providers and other members is protected by copyright and other laws.
The operator is entitled at any time to immediately block individual users' access to online platforms in the event of a violation of these terms of use or if there is a suspicion of non-compliant or improper use. In such cases, the operator may issue warnings to affected users at its own discretion, but is not obliged to do so.
The use of the online platform may be temporarily, partially or completely unavailable, in particular for technical reasons. In particular, the operator is entitled to interrupt access to online platforms for maintenance work. The operator endeavors to ensure the highest possible availability of the online platform, but cannot guarantee this.
The operator is not obliged to monitor the behavior of providers, users and members on the online platforms. In particular, the operator is not obliged to check content from users and providers for legality or other admissibility as a precautionary measure. The operator accepts no liability for the content of users and providers. In the event of inquiries, complaints and other information from third parties in connection with content that is suspected to be illegal or otherwise not permitted, the operator shall comply with the Code of Conduct Hosting (CCH).
The operator is liable for direct damage caused by its own gross negligence or intentional acts. Any further liability of the operator for direct damages is expressly and fully excluded. Any liability of the operator for indirect damages and consequential damages, for claims of other users or any third parties as well as for loss of profit is expressly and fully excluded. Any liability for vicarious agents is excluded.
Members are expressly and fully liable to the operator and any third parties, regardless of fault, for all direct and indirect costs as well as for damages arising from violations of these terms of use or in connection with the online platforms. The indemnification also includes claims of other members and any third parties. The members concerned shall indemnify the operator against all claims by other members and any third parties and undertake to bear all costs – including legal fees and court costs – as well as direct and indirect damages incurred by the operator in this context.
The limitation of liability in accordance with these terms of use applies regardless of the legal basis. Any further mandatory liability, in particular for gross negligence or intent and in accordance with any applicable data protection law, remains reserved.
Automated access to the online platforms, for example using bots, scripts or similar means, is prohibited. The operator may provide for exceptions, such as the use of programming interfaces.
The operator is entitled to change these terms of use at any time without giving reasons. Users will be informed in an appropriate manner of any significant changes to these terms of use.
These terms of use are governed exclusively by Swiss law. The place of jurisdiction shall be governed by the mandatory statutory provisions. Insofar as these do not apply, the exclusive place of jurisdiction for all types of proceedings is Lucerne (Canton of Lucerne), as is the place of performance and enforcement for users and providers without a domicile or registered office in Switzerland.
